On the morning of Sunday, May 26, an SUV crashed into a waterway west of Stockton, killing 28-year-old Rafael Ontiveros, 40-year-old Adrian Pena, and Luis Cuevas, as well as two other people. While traveling in a 2002 Chevrolet SUV, the driver veered from the roadway, crashing down a levee and into the water. None of the victims were found inside of the vehicle when it was removed from the water. Rescuers located them afterward, finding the last two male victims on Wednesday. The accident is under investigation.
“After a fatal accident, the families of the victims may file wrongful death claims against the negligent driver in order to hold him or her liable for their loss,” explained California injury lawyer James Ballidis.
Motor vehicle collisions claimed the lives of or caused injury to 1,660 people in Stockton in 2010, according to the California Office of Traffic Safety. The OTS ranked Stockton 4th out of 13 cities with populations of more than 250,000 for its incidence of fatal and injury collisions in a ranking system in which 1st place is considered the worst.
