Linda Vista: David Rodriguez Benito Killed in Crash with Drunk Driver

At about 12:10 a.m. on Thursday, August 15, 27-year-old David Rodriguez Benito was killed and his 19-year-old brother was seriously injured in a crash with a drunk driver in the Linda Vista area of San Diego. Forty-one-year-old Matthew Kim struck Benito’s Mazda sedan with his Toyota pickup truck at the intersection of Linda Vista Road and Tait Street. Benito was pronounced dead at the scene. Emergency responders transported his brother to an area hospital. Kim was arrested on suspicion of felony drunken driving and manslaughter. The accident is under investigation.

“After a fatal collision, the family of the victim may pursue a wrongful death claim against the negligent driver in order to hold him or her liable for their loss,” explained California car accident lawyer James Ballidis.

Throughout San Diego County, 17,889 people were killed or injured in traffic accidents that occurred in 2010, according to the California Office of Traffic Safety. Alcohol was a contributing factor to 17,889 of the fatal and injury crashes that occurred in the county that year, which ranked 32nd out of the state’s 58 counties for its incidence of DUI crashes in a rating system in which 1st place is considered the worst.
